Posted by Pattie Causey [pacausey (at) mindspring.com] Will of Andrew Caldwell, Hempstead Co., AR Andrew Caldwell, Book C, page 1 "In the name of God Amen, I Andrew Caldwell of the County of Hempstead and State of Arkansas, being of sound mind and disposing memory, but of feeble health, considering the uncertainty of life, and wishing to dispose of my earthly effects according to the liberties granted to me by the law of our happy country, do make and declare this to be my last Will and testament as follows; to wit: I will my body to the grass and my soul to the god who gave it being. It is my Will and request that my Executors herein after named shall as soon as Expedient collect in all dues and debts owing to ? and that they shall also, as soon as convenient, and proper, pay all just debts owing by me. I will and bequeath to my daughter Nancy Roberts Ten Dollars which I direct my executors to pay to her. I will and bequeath unto my sons William Caldwell and Thomas J. Caldwell the following named negro Slaves for life; to wit: Winney, a negro Woman, and her Son Jacob, a negro Woman named Phillis, a negro Girl named Margaret, one negro Girl named Elry, a negro Girl named Viny, a negro girl named Hannah and one named Harriet a negro girl named Caroline. In trust however and for the uses and purposes herein after specified. That is to say the said Trustees shall hold in trust for the use and benefit of my daughter Mary Moss and her children, the said negro woman named Winney and her son named Jacob. And shall hold in like trust for the use and benefit of my daughter Anny Nance and her children the said negro Woman named Philles, and the said negro girl named Margaret, and also in like trust for the benefit of my daughter Lucinda Palmer the negro Girl named Elry, and also in like trust for the benefit of my daughter Elizabeth Jackson the said negro Girl named Viny. And also i! n trust for my daughter Margaret Pawly the negro Girl named Hannah and the said negro girl named Harriet and also in like trust for my daughter Nelly Watson, the said negro girl named Caroline. And also upon the further trusts and and conditions that the said Trustees shall give to Each one of my aforesaid daughters, the free use, possession and benefit of the services, work, labor and attendance of the said several negroes, so held in Trust for Each respectively during her natural life, and that upon the death of either one of my said daughters, the negro or negroes, so held in Trust for her and the children, shall then be by the said Trustees divided among her children. Provided also that said Trustees are to be free from all accounting for the hire and profits of said negroes and from all responsibility for the care and safekeeping of said negroes while they may be in the service and possession of my said daughters respectively. I will and bequeath unto my son William Caldwell one negro man named Stephen. I will and bequeath unto my son Thomas J. Caldwell one negro Boy named Abram and one negro Boy named Henry. I will and bequeath unto my son Joseph Caldwell one negro man named Edmond. I give and bequeath unto my son James D. Caldwell a negro ? (too dark to read) named Alfred? and a negro Woman named Mary together with Two Hundred and forty acres of land including my dwelling House. The said negro Woman Mary I bequeath to my son James on condition that he pay to each one of my Grand children Wesley Bailey, Harriet Bailey and William Bailey the children of my deceased daughter Sarah Bailey, as they severally become of age, the sum of One Hundred Dollars Each, and pay to Each of his brothers, William, Thomas J. and Joseph the sum of Fifty Dollars to be paid to them at the time when my said son James gets possession of the said negro Woman Mary, But if my son James should neglect or refuse to comply with the conditions above stated, either of his said Brothers shall be entitled to the said negro Woman Mary by making the payments and complying with the conditions above named. I give and bequeath unto my Two Grand children Jane Hays and William Hays One Hundred and Sixty acres of land, it being two Eighty acre entries lying South of my present residence, each of them to share equally in the above bequest. The Stock remaining on my farm, my cattle, horses hogs and Sheep with my farming utensils and Crop I wish to be applied to the payment of my just debts and funeral expenses, and the balance remaining if any there be, to be equally divided between my four sons William, Thomas J., Joseph and James D. Caldwell. I also give and bequeath to my daughter Margaret Pawly and her children The Southeast quarter of the North East quarters and the North East quarter of the South East quarter of Section Twenty one of Township Eleven South of Range twenty six West, and I also bequeath to her Ten acres of land adjoining the before mentioned tract a parcel of land to be taken off of the land given to my son James D. Caldwell, and to include the Spring and the old House where my daughter Nelly Watson formerly resided. All of which said lands bequeathed to my daughter Margaret Pawley, I give to her for her use, benefit and Enjoyment, and that of her children during her natural life, and at her death to her children to be equally divided between them. I also give and bequeath to my Grand daughter Mary Ann Pawly, the North East quarter of the North West quarter of Section Twenty one in Township Eleven South of Range Twenty five West, the Bed, Bedstead with its furniture which I now occupy I also g! ive to the said Mary Ann Pawly, and I also bequeath to my Grand daughter Martha Nance a Bed & Bedstead with its furniture, as nearly like the former as can be conveniently procured and which I direct my Executors to procure for her. It is my farther wish and desire that my household and kitchen furniture not otherwise already disposed, be divided by my executors herein after named amongst my children as they shall deem it right and proper. And I hereby constitute and appoint William Caldwell and Thomas J. Caldwell the Executors of this my last Will and Testament and wish and direct that no Security be required of my said executors for the faithful performance of the several trusts and duties herein required of them, And I the said Andrew Caldwell do hereby revoke, renounce and set aside as nought? any and all former Wills made by me, and do hereby declare this to be my last Will and Testament. Abstract of his will reads as follows: Stringfellow, Robert E., farmer of Water Creek, County of Hempstead and State of Arkansas, Last Will and Testament, written May 20, 1882 and witnessed by C. W. Graham and B. F. Hanchey. He bequeathed all his lawful heirs one dollar. He left the rest of his estate, consisting of 102 acre farm, livestock and household and kitchen furniture, to his wife, Earthly C. Stringfellow. No Executor was named.
