Indexes To Deeds

When we hear that a courthouse burned in xxx year we automatically assume that there are no records to be found prior to that date. That is true in almost all cases except for Land Records. To sell a piece of property the Title Company requires that the chain of ownership be intact from the current seller all the way back to the first deed that transferred land from the government (or other entity) to the first purchaser.

Normally after a courthouse fire all residents of the county bring their deeds to the courthouse to have them re-recorded. The Title Attorneys of a county try to re-build the chain of ownership on every piece of property. In most cases this information is recorded in the first few deed books.

This is true of Marion County. The first 3 deed books (A, B & C) contain a lot of old deeds, deeds from before the courthouse burned. It is true that some deeds were not re-recorded and the information on the chain of ownership is found only at the abstract companies (who are not interested in helping genealogists!). But, these 3 deed books may be the only reference you find to one of your ancestors in Marion Co, especially if the came and went before the courthouse burned in 1887.

The Deed Books of Marion County have been filmed by the LDS and can be ordered from your local LDS Family History Center. (see Resources on the Main Page for a list of all the records of Marion County that can be ordered from the LDS)

Copies of these Deeds can be ordered from the Yellville Courthouse (see Courthouse on the Main Page)

And if you do not already know - a wife was required to sign a deed for land being sold or mortgaged because land was the wife's "dower". Many times deeds are the only place you will find a wife's name.

The Index to Deed Book "A" is a separate "book" stuck in the front of the Deed Book. This poor old list is literally in tatters. I would very much like to have an accurate list to send to the courthouse to replace this existing index.

To do that I need your help !!!!!

In the indexes for Deed Books A B & C some of the handwriting is clear and easy to read, but some of the handwriting is pretty bad. Please look over the Indexes and if you spot a name misspelled or initials wrong please let me know. Especially for Deed Book "A"
