This 1862 Scott County Will was found recorded in 1866 in Grayson County, Texas by Tressie Nealy. This is very important due to the destruction of all the Scott County records in the courthouse fire of 1882.

The County of Scott – State of Arkansas

In the name of God Amen
I JAMES MYERS of the County of Scott and State of Arkansas being weak in body but of sound mind and memory do make and publish this instrument of writing to be my last will and testament

I will and bequeath to my beloved son ROBERT M MYERS a certain tract of land as follows – the east half of the southwest quarter of section thirty two in township three north of the base line in range thirty two west of the fifth principal meridian containing eighty acres

I will and bequeath to my beloved son J F D MYERS all the land south of the Poteau River belonging to the south west quarter of south east quarter of section #30 in township three north of range #32 west containing forty acres.

Also all the land south of said river belonging to the south east fraction of the north west fraction quarter of section #31 in township #3 north of range #32 west containing 38 acres and 88/100.

Also the north east quarter of the north west quarter of section 31 in township #3 range 32 all that quarter south of said river.

I will and bequeath to my beloved son LAYFAETT MYERS all the land lying north of the Poteau River belonging to south west quarter of south east quarter of section #30 in township #3 north of range north 32 west – Also that part lying north of said river belonging the south east fraction of the north west quarter fraction of section #31 in township 3 north of range #32 west containing 38 acres 88/100.

Also all that part lying north of the Poteau River belonging to the north east quarter of the north west quarter of section 32 in township 3 range 32.

Also seventeen and half acres adjoining the last name land being a lot of land I purchased from C L MOORE and I desire the middle of the Poteau River shall be the line between the two last named sons.

I will my son ROBERT M MYERS my black stud horse and three Spanish mares and five cows and one gray mare and colt and one bed and

I will to my son J F D MYERS one wagon and one yoke of oxen and three Spanish mares and one year old filly and two mules and two cows and calves one bed and furniture.

I will to my son LAYFAETT MYERS one black horse and three Spanish mares and three year old mules and two mares and two year old colts and three cows and calves one bed and furniture and -

I desire all the house hold and kitchen furniture and farming utensials to stay on the farm for the use of family

The remained of my stock I desire ELIZABETH ROCKWOOD to have for the use of the family.

I nominate and appoint E W MYERS and ELIZABETH ROCKWOOD my executors to this will.

In testimony whereof I have hereunto set my hand and seal on this 28th day of Oct 1862.

The County of Scott – on this 28 day of Oct 1862 Before me A L BETHEL an acting and duly commissioned Justice of the Peace for the County of Scott in the State of Arkansas appeared in person JAMES MYERS to me personally well known as the person whose name appears upon the writing and foregoing will and states that he had executed the same for the purpose therein mentioned and set forth and I do here so certify

In Testimony I have hereunto set my ____ as ____ Justice __ the Peace at the County of Scott in the State of Arkansas on this 28th day of Oct 1862
