APPLICATION FOR PENSION

To the Honorable County Court of Scott County
Sitting as a Pension Board:
The undersigned, as an ex-Confederate soldier, hereby applies for a pension under the provisions of an act of the General Assembly of the State of Arkansas, entitled "An Act for the Relief of Certain Soldiers of the late War between the States," approved April 1, 1891, upon the following grounds:
That he is a bona fide citizen of the State of Arkansas, and has resided within this State for more than twelve months next before the filing of this application;
That he enlisted as a soldier in the State of North Carolina during the war between the States in Company B of the 42 Regiment of North Carolina Volunteers.
That while in the discharge of his duty as a soldier of said company and regiment in the service of the State of Arkansas, or of the Confederate States of America, he received a wound, from the effects of which he lost the use of his right leg to the extent that he is incapacitated for manual labor.
That by reason of said wound and disability he is now indigent and incapacitated for manual labor;
That he is not receiving any aid from this State or from the United States, for such injuries, under any other statute, and that therefore he makes application for relief under the act aforesaid.

Affidavit

On this 25th day of September 1891 personally appeared before the undersigned a Clerk of the Circuit Court Daniel Orton, Ex Confederate soldier of Co. B of the 42nd Reg't. N.C. Volunteers, who being first duly sworn states: That he is the identical person who served in said Company and Regiment during the late war. That his age is 52 years. That while in the aforesaid service he received a gun shot wound from the effects of which he lost almost entirely the use of his right leg. That he has suffered continuously from said wound during the whole time since the same was received to the present time. That his sleep is disturbed at night on account of the wound paining him, the bullet being still lodged in right leg and hip. That said wound runs all the time, frequently in the course of twenty four hours a teacup full of corruption coming from the wound and often for a month at a time being unable to do any work. That affiants comrades and witnesses present when he received said wound are all living at a distance, none living in this part of the country to affiants knowledge.

Duncan, County Clerk of Scott County, constituting the Pension Board of said County, by Act of the General Assembly of the State of Arkansas, approved April 1, 1891, entitled "An Act for the Relief of Certain Soldiers of the Late War Between the States," do hereby certify to the Auditor of the State of Arkansas that upon examination of the application of Daniel Orton filed under said Act, we find that said claim of said applicant is just and the same is hereby allowed, the application and proof taken in said case being herewith transmitted. Given under our hands and the Seal of the County Court of Scott County, on this 22 day of October, 1891.

This is to certify that I am personally acquainted with D.W. Orten, that I was his family Physician for several years, and that he has a gun shot wound in right hip, which is almost continuously discharging pus, that the limb is shorter than the left, and that there is partial paralysis of same. He says that said wound was received during the war while engaged as a Confederate Soldier.

In matter of pension claim of Daniel Orton ex-Confederate Soldier of Company B of 42nd Reg't. of North Carolina Volunteers
On this 25th day of Sept. 1891, before me, the undersigned, Clerk of the Circuit Court, J.P. Duncan whose age is 53 years, and who being first duly sworn says: I first became acquainted with said soldier Daniel Orton about the year 1880 and when I first became acquainted with said soldier he was suffering from wound in right leg received so he said in the aforesaid service. Have seen him often during the whole time since I first became acquainted with him to the present time and he has always complained of said wound, and at times it pains him so that he is unable to do any work whatever. By reason of said wound he is now indigent and incapacitated for manual labor.
Affiant further swears that he has no interest direct or indirect in this claim, and that his knowledge of the above facts is derived from long acquaintance with said Soldier and often hearing him speak of his disabibility on account of said service.

APPLICATION FOR PENSION

I, Daniel Orton do solemnly swear that I served as a soldier in the army of the Confederate States, being a member of Company "B" commanded by Capt. Crawford, in Col. Brown's 42nd Regiment of Infantry Vols. from the State of North Carolina; that I was honorably paroled from such service at the close of the war on or about the [blank] day of May, 1865, and did not desert the same; that I am now, and for the past twelve months have been, a bona fide resident of this State; that I do not myself, nor does my wife, nor do we both together, own property, real or personal, or both, or money or choses in action in excess of the value of $400.00 (exclusive of household goods and wearing apparel), nor has either of us conveyed title to any property to enable me to draw a pension, and that neither I nor my wife is in receipt of any income, annuity, pension or wages for any service, the emoluments of an office, in excess of $150.00 per year; that I am incapacitated to perform manual labor in any of the ordinary avocations of life, and that such incapacity (or disability) is the result of wounds received in the service, being gun shot wound in right leg, the ball being still lodged in flesh of right hip and same causing a permanent running sore and causing considerable pain all the time, as well as from advanced age, my age being now about 60 years, and consequent debilitated physical condition, and that such disability is not the result of my own vicious habits still persisted in, so help me God.

Crawford, a citizen of Saulsbury, N.C., whom I certify to be a creditable person and worthy of confidence, who being duly sworn, states that he is personally, well acquainted with applicant Daniel Orton, having known him for 3 years.
That he was a Confederate soldier. Belonging to Company "B" 42nd Regiment of North Carolina Infty. Vols. That as such soldier he served from March 8th 1862 to the close of the war in Spring 1865. That he was honorably paroled from such service, and did not desert the same. That I have no interest in this claim. I was Captain of the Company in which soldier served.

I, J.W. Sorrels a duly registered and practicing physician in Scott County, Arkansas, do hereby certify that I am personally well acquainted with Daniel Orton of Abbott, Arkansas, who is an applicant for a pension under the Statutes of Arkansas.
That at his request I have made an examination of his physical condition and find: State description and character of wound or disability: He has a gun shot wound in hip. There is almost constant discharge from wound which renders him unable to perform manual labor.
Physical condition and to what cause is his incapacity for manual labor attributable: To the affected condition of the entire hip. He has also been suffering for several years with chronic gastritis or catarrh of the stomach which of itself is very serious and that said disability is not the result of his own vicious habits still persisted in.

My Dear sir & friend
I would represent to your Honorable Body that I am an Ex Confederate soldier, was badly wounded while serving my country in the Army and am now carrying a miny ball in the bone of my right hip and the wound is running or discharging puss daily and gives me so mutch pain that I can scarcely do an hour's work during the day and I sleep but little at night and I will further state that the records in Little Rock will show who and what I was during the civil war and I will further state to you that the pension board has granted me a pension which gives me Seventy Five Dollars $75.00 per year. And I come to you and ask your Hon. Body to pass a special act to give to me and other old soldiers that was as badly wounded as myself the full amount in cash allowed us by the Pension Board.
I believe the above representations of Mr. D.W. Orton are true.

I, D.W. Orton do solemnly swear that I am now, and for the past twelve months have been, a bona fide resident of this State; that I am now drawing a pension as an ex-Confederate soldier, under an Act of the General Assembly of 1901, having made my original application from the county of Scott; that I am still in indigent circumstances; that I do not myself, nor does my wife, nor do we both together, own property, real or personal, or both, or money or choses in action in excess of the value of $400.00 (exclusive of household goods and wearing apparel), nor has either of us conveyed title to any property to enable me to draw a pension, and that neither I nor my wife is in receipt of any income, annuity, pension or wages for any services, the emoluments of an office, in excess of $150.00 per year; that I am incapacitated to perform manual labor in any of the ordinary avocations of life; that my disability has increased, and I am less able to perform manual labor than when my original application was made, by reason of gun shot wound received in the service and I hereby make application for an increase of pension, under Act of the General Assembly of 1907.

Orton, deceased, late of Scott Co., Ark., who served as a soldier in the army (or sailor in the navy) of the Confederate States, his proof of service being now on file in the Auditor's office, at Little Rock, he having been allowed a pension under Act of the General Assembly, approved March 11, 1901, while a resident of Scott County, Arkansas, that I am now, and for the past twelve months have been a bona fide resident of this state; that I do not own property, real or personal, or both, or money or choses in action, in excess of the value of $400.00 (exclusive of household goods and wearing apparel), nor have I conveyed title to any property to enable me to draw a pension, and that I am not in receipt of any income, annuity, pension or wages for any services, the emoluments of an office, in excess of $150.00 per year; that my husband died on the Thirtyeth day of January 1908 near Abbott, Scott County, Arkansas and that I have not since remarried, so help me God.
