PREFACE:

Hello - My name is Carolyn Glover Stratton. I have become obsessed with genealogy and history. I am a native of Kansas, but I married a Faulkner County young man and have spent most of my adult life in Conway. I worked for attorneys in Chicago, Tulsa and Wichita Falls, Texas.

I also worked for State Senator Guy Hamilton Jones in 1953/54. His law office at that time was upstairs in the Halter Building. I was 17 - I worked from 9 am to 12 noon. (I worked 15 hours a week and earned $15) He came to work at noon and we met at Greeson's Drug Store which was also in the Halter Building. I would discuss the morning's business with him and the next morning he would leave notes for my work for that day.

This was where I got interested in politics and law. I left Conway to marry Royce Glover at Sheppard Air Force Base, Wichita Falls, Texas. Later after several years in the Air Force we settled back in Conway. I went to work for Senator Jones again on May 30, 1968 and worked there with him and his law partner, Phil Stratton, whom I married about 4 years after my first husband, Royce J. Glover passed away.

I have spent a lot of time at the Faulkner County Courthouse - searching deed records, divorce records and other matters. This experience has made it easy for me to find things other people are interested in and I really enjoy doing the research.

The following is a summary of the "Docket of County Judge, Faulkner County, Arkansas" consisting of pages 1 through 71. The time period is from November 8, 1894 through November 5, 1902. The County Judge in that time period sat as a Law Judge does today.

County Judges did not have then, and do not have now any legal training. Most of the cases in this docket book pertained to Bastardy, Insanity and Incarceration. I will attempt to transcribe the pertinent information, but in some cases verbatim is necessary.

When I mention marginal note or marginal record I refer to an entry in the margin of a docket entry. Even today mortgage companies will make a marginal release when a mortgage is paid. Otherwise they have to prepare a release deed and pay a filing fee to record same.

I did not realize until I saw this book that marginal entries dated back to 1894 (and possibly before). And where it says "as per his return" - that refers to a sheriff making a report to the court! that he has obeyed the order of the court. Spelling and punctuation is not corrected.

/s/ indicates "signed by".

Remember - this is a public record and this transcription is not intended to harm anyone. We all have family skeletons, but this is what makes genealogy research so much fun and makes it impossible to quit! So here we go! (And the first bastardy case involved a Glover!)

At the tope of each page it states "Docket of County Judge, Faulkner County, Arkansas. Cases Brought and Tried Before _______ County Judge, Faulkner County, _______, 189__." On Page 1 the blanks are filled in as G. W. Rice, County Judge and the date of Nov. 8, 1894. These blanks are not filled in again until Page 49 when it shows W. H. Duncan - Nov. 1898. Judge Duncan entered his name on every page. On page 71 it shows W. B. Wilson as County Judge with date of Nov 5, 1902.

State vs S. E. Lasley, Bastardy: On Oct. 9th 1899 Flora C. Pennington having filed with me an affidavit charging S. E. Lasley with the crime of Bastardy, a warrant for his arrest is issued, placed in hands of sheriff, returnable 1st Monday in Jan. 1900 and bond fixed at $400.00.

J. M. King, Ex Parate: Held for manslaughter by E. G. Browning J.P. 10/12/99. I granted him bail in the sum of $750.00 on writ of habeas corpus.

10/19/99 :Faulkner County Court - State of Arkansas Ptff, relation of Nannie Smith, Bastardy, vs. Floyd Gibbs, Deft. Plaintiff in person and by attorney and defendant in person and by attorney and by consent of all parties the following judgment is rendered. Upon defendant paying $25 in cash to Nannie Smith and his executing eight notes for Ten dollars payable 3, 6, 9, 12, 15, 18, 21 and 24 months after date and payable to Nannie Smith and one note for forty dollars payable to Nannie Smith on January 1st 1902 and costs of this suit - same shall be in full satisfaction of this judgment.

Morris Loch vs Frank Schichtl. Dec. 11th 1899. Morris Loch makes application for writ of habeas corpus for Frank Schichtl who is said to restrain Morris Loch, his son and a minor and deprive him of the services of his son. Said writ is issued and handed to W. S. Hendrickson, Sheriff, returnable Dec.11th 1899 at 3 pm. Said writ is returned and Frank Schichtl appears in person together with Morris Loch and answers that he has not restrained said minor and delivers him over to his father and said petition is dismissed at cost of petitioner. W. H. Hendrickson's cost $1.20 pd. W. H. Duncan's cost $2.30 pd. John Mayor agreed to pay.

Dec. 14th 1899. Whitly Brown appointed beneficiary to Branch Normal College at Pine Bluff.

Wm. Birdsong vs. Minnie Tuggle. Dec. 16th 1899. Wm. Birdsong filed an affidavit and petition for writ of habeas corpus to get possession of his son Oscar Birdsong, a minor, charging that Minnie toggle had charge of him. Cebron Harper, Ex Parte. April 12th 1900. C. Harper by his attorney G. W. Bruce applies for writ of habeas corpus for release of C. Harper who is confined in jail of Faulkner County upon a commitment of E. G. Browning J.P. for nonpayment of a fine for Sabbath breaking and writ is issued and made returnable at 3 p.m. Upon hearing it is ordered that said C. Harper be released.

Arthur Hoffman and Mary Hoffman vs Lawrence E. Halter. Petition for writ of Habeas Corpus. On June 14th 1900 Arthur and Mary Hoffman apply for writ of Habeas Corpus to obtain possession of Clara Darsheid, sister of Mary Hoffman and a minor. Writ is issued returnable June 15th 1900. On June 15th 1900 this matter comes for hearing upon petition of Ptffs, return of officer and answer of Defendant and testimony of the witnesses. Ptffs represented by G. W. Bruce and the Deft. By G. W. Rice and Sam Frauenthal. Upon hearing the testimony adduced and the minor agreeing, she being over the age of 14 years, the custody of the child, Clara Dorsheid is give to Ptffs at their cost. W. State of Arkansas, Faulkner County. Whereas, I, Mary Dayer, an unmarried woman of said County and State, being of full and lawful age charges that on the 21st day of March 1900 she was delivered of a bastard child by now named John Franklin and that John Moix is the father of said child and whereas said John Moix has agreed to pay said Mary Dayer the sum of Twenty Dollars in lieu of lying in expenses and in full of all other claims which the said Mary Dayer has or may have against the said John Moix by reason of said charge, which sum the said John Moix has full paid to me, the receipt of which is hereby acknowledged and upon which and for which I hereby release him from any further payments this July 7th 1900. /s/ Marie Dayer. J. S. L. Wright, Ex Parte. May 20th 1901. On this day I had J. S. L. Wright examined by Drs. Dickerson and Greeson upon a charge of insanity, made by W. B. Wilson, adjudged him insane and committed him to jail, awaiting a decision from Supt. State Lunatic Asylum.

J. S. L. Wright, Ex Parte. May 24th 1901. On this day, J.S. L. Wright was ordered to the State Lunatic Asylum.

State of Arkansas vs James Montgomery. Bastardy. On this June 10th 1901 an affidavit filed charging James Montgomery with the offense of bastardy alleging that Lou Glover is pregnant with child by James Montgomery and when born will be a bastard. Warrant issued for his arrest and Deft. Permitted to give bond in the sum of $400.00 for his appearance at the next Oct. term of the County Court on the first day thereof and warrant handed to sheriff.

Mary Flag, Ex Parte. July 25th 1901. Mary Flag, who is confined in the County jail on a charge of grand larceny in default of $100 bail, applies to me for a release or a reduction of bail. After reading the testimony and examining the petitioner, I am convinced that the testimony is not sufficient to hold her in jail at the expense of the county. She is therefore released upon her own recognizance to appear at the next term of the Circuit Court.

Susan Griffing, Ex Parte. On July 25th 1901, Susan Griffin who is confined in the County jail on a charge of grand larceny in default of $100.00, applied to me for a realease or reduction of bail. Same as above - released upon her own recognizance.

Ethel Harrell, Ex Parte. On Aug. 1st 1901, I appointed Ethel Harrell a beneficiary to the Deaf Mute Institute.

Martha Ross, Ex Parte. Sept. 3rd 1901. Mrs. Martha Ross files with me an affidavit that one Andy Elkins has her daughter Kate in custody, who is under 18 years of age, and is leaving the state and prays for a writ of Habeas Corpus for said Elkins to produce said girl in court and give reasons for her detention. Writ issued and delivered to sheriff and made returnable Sept. 5th 1901. On Sept. 3rd all parties concerned appeared before me and announce themselves ready and after hearing all the testimony, the custody of Kate Ross is awarded to Mrs. Ross sat costs of Andy Elkins.

State vs George Lind. Oct. 17th 1901, Maud Chrouch filed with me an affidavit stating that she had been delivered of a bastard child on February 9th 1901 and that George Lind was the father. Prays for warrant of arrest. Warrant issued, handed to J. H. Harrell, Constable of Cadron Township, returnable Oct. 19th 1901 and bond fixed at $200.00.

On 19th day of Oct. 1901, the day set for the hearing of this cause, the Defendant, George A. Lind appeared in his own proper person and the State of Arkansas by its attorney, G. W. Bruce and the father of the prosecuting witness and Defendant acknowledged that he was the father of the child delivered from Maud Chrouch on Feb. 9th 1901 in Faulkner County, Arkansas and prayed the court to be as lenient with him as possible. Wherefore, George Lind is adjudged guilty of bastardy in this case and is ordered to pay the costs herein, being $4.55 and is ordered to pay Maud Chrouch $5.00 lying in expenses, and $16.00 being $2.00 per month for maintenance of child from Feb. 9th 1901 until Oct. 9th 1901 and that he pay Maud Chrouch $2.00 per month on the 9th of each month till Feb. 9th 1908 if said child live that long, and in the event of its death the payments are to cease and further that he enter into bond in the sum of $300.00 to the Sate of Arkansas with good and sufficient security to comply with this judgment. George Lind presents bond in sum of $300.00 with A. S. Lind and W. L. Whitten as sureties and pays costs and pays G W. Bruce, attorney for Ptff $21.00 and is discharged. County Judge cost $2.15 paid, Constable's cost $2.40 paid.

B. T. Pitts, Ex Parte. Oct. 24th 1901. B.F. Pitts files verified affidavit and petition for writ of habeas corpus for possession of his son Howard Home Pitts and alleging that Hattie Willcutt and Robt. Watts have possession of said child and refuse to turn him over to his father. Writ issued, returnable Oct. 26th 1901.

Oct. 26th 1901. Hattie Willcutt appears and asks for a continuance of this case until Oct. 29th, which is granted. Oct. 29 1901. Parties to this suit appear in person and by attorney, announce ready for trial and trial of the case is entered into. The court after hearing all the testimony doth award possession of the child, Howard Pitts to his father B. T. Bitts (sic) and B. T. Pitts will pay all costs.

Mrs. Addie Rowlett, Ex Parte. Nov. 2nd 1901. This person was sent to the State Lunatic Asylum.

Dec. 12th 1901. John M. Whitten to Miss Vida Joslin. I married this couple.

Dec. 17th 1901. John M. Thompson, Ex Parte. This young man is appointed a beneficiary to the Branch Normal College of Pine Bluff, Ark.

Henry W. Johnson (Col), Ex Parte. Dec. 30th 1901. This young man was appointed a beneficiary to School for the Blind.

G. W. Goad vs. J. P. Thines and Directors of School Dist. No. 58. Jan 2nd 1901. A temporary restraining order issued restraining J. P. Thines, County Treasurer from paying, and directors of Dist. 58 from issuing any warrant to Miss Grace Charter until the matter is adjudicated by the Faulkner Chancery Court.

Ellen Lawrence, Ex Parte. Jan. 7th 1901. This lady was given a certificate to attend the School for the Blind.

Carroll Bradley, Ex Parte. Jan. 17th 1901. Carroll Bradley applies for bail, he having been held by J. A. King J.P. on a charge of manslaughter and bail is fixed at $1,000.00.

State vs John Phillips. Jan. 20th 1902. Grace Shoemaker files affidavit charging John Phillips with offense of bastardy. Warrant for his arrest is issued and given to the aggrieved woman and bond of Deft. placed at $350.00.

Mrs. Mary Simpson, Ex Parte. March 18th 1901. Upon complain of C. C. Thomason this person was examined on charge of insanity, Drs. Voris and Dickerson, physicians. Adjudged insane and ordered to State Lunatic Asylum for care and treatment. Admitted.

State vs. E. E. Bruce, Bastardy. April 2nd 1901. Ella Simmons filed affidavit charing E. E. Bruce with offense of bastardy. Warrant issued, returnable April 7th 1901, bond at $200.00.

Annie Hunt, Ex Parte May 16th 1901 G. W. Hunt files affidavit charging Annie Hunt with being insane. Drs. Ringgold and J. H. Voris are deputized to examine her, and from the affidavit, examinations and other testimony, Mrs. Annie Hunt is adjudged insane and ordered sent to the State Lunatic Asylum. Refused admission sowing to lack of room.

Bell from custody. It is further ordered that G. W. Bruce an atty of this court be permitted to sign said bond as surety.
